Age discrimination grounds for litigation in New York

Fiat Chrysler Automobiles was recently accused of engaging in discrimination on the basis of age. The company allegedly mistreats older workers when completing their performance evaluations. If employees in New York face age discrimination, they have the right to seek justice through the civil court system.

One allegation made against the automobile company is that company officials would use workers’ photographs during their performance reviews. Upper-level management has been accused of giving lower scores to those employees who are 55 years old or older. This reportedly took place even when the immediate supervisors of the employees had given these employees glowing reviews.

According to the recently filed lawsuit, upper-level management’s low scores ultimately led to lower pay to older workers. In addition, older workers would receive fewer promotions compared to younger employees at the company. The company, however, reported that it does not approve of any type of discrimination, including age discrimination. The company was recently accused of engaging in race discrimination as well.

Age discrimination is illegal in New York and other states, but it remains a real problem in the workplace. Anybody who experiences this type of discrimination has the right to try to seek his or her employer accountable by filing a discrimination claim against the company. Understanding what facts need to be proved is necessary in order to prevail in this type of legal case. Remedies in a successfully fought case may include the reinstatement of a job, promotions, back pay and other monetary relief, depending on the circumstances surrounding the case.
