Biography

KIM PATRICIA BERG is a founding partner of Gould & Berg, LLP. Throughout her career she has focused her practice in the area of labor and employment law, discrimination, retaliation, civil rights, commercial litigation and mediation.

Ms. Berg's representation of both employees and small employers, coupled with her role mediating cases on behalf of her clients and as a certified mediator on numerous court mediation panels, provides her with a unique and well-rounded perspective toward employment disputes and litigated matters. She routinely pursues and defends claims before administrative agencies such as the EEOC, NY State Division of Human Rights, New York City Human Rights Commission and New York State Department of Labor, as well as before trial and appellate courts in the state and federal courts throughout New York. She has successfully tried and resolved hundreds of cases throughout her career. Her success at trial in a complex prisoner death case won her accolades for the highest verdict in a civil rights case as reported by Verdict Searches "Top NY Verdicts for 2009." Year after year, she is named to the New York Super Lawyer's list.

In addition to being an experienced litigator, Ms. Berg provides advice and consult to employees and small employers analyzing the particular issue to determine cost effective solutions, developing strategies for easing difficult work environments or dealing with difficult employees, mediating disputes, and conducting investigations into employee complaints. Ms. Berg guides employers on all facets of local, state and federal employment laws, discrimination policies and reporting procedures. She conducts internal investigations, presents mandated annual trainings, prepares employer policy manuals, and advises employers on key issues relating to department of labor classifications of workers and pay/overtime rates. Ms. Berg routinely reviews, drafts, revises, and negotiates employment, independent contractor and separation agreements.

Ms. Berg is an active member of numerous local, state and federal bar associations where she routinely serves as a panelist on legal topics. She has been recognized for her leadership and excellence in the profession and as a staunch advocate for and provision of mentorship to others.
