Wage law violations result in back pay for affected workers

There are many times when New York workers may want to earn a bit more income in a given week. As a result, they may work some overtime hours in efforts to reach that goal. In other cases, overtime may be mandatory simply due to the amount of work that the employees need to complete. In either case, eligible workers should receive overtime pay. Unfortunately, that is not always the case, and employers may violate wage laws.

It was recently reported that a company in another state is required to pay back certain workers due to a lack of overtime compensation. Apparently, 41 workers were eligible for overtime pay. Despite having worked overtime hours, their employer did not provide them with the compensation required under law.

The Wage and Hour Division of the Department of Labor indicated that the company paid workers flat salaries instead of accounting for overtime hours for workers who were eligible for that extra pay. Additionally, the company did not count commissions or bonuses when determining overtime, and it did not have proper documentation of hours worked by employees. As a result, the company must pay $102,767 in back pay to the 41 affected workers.

For some, receiving overtime compensation is a benefit they rely on. For others, they may simply enjoy receiving that extra bit of income. Whatever the case, if workers are not being properly compensated for overtime hours, they may need to consider their legal options. Violations of wage law can cause New York workers to lose out on substantial amounts of income, and they have a right to fight for their earned wages.
