Orange County Employment Lawyer Explains if a Live-In On-Call Superintendent Is Owed Overtime Pay


As Orange County Employment Lawyers, we have a number of situations in our office with clients who own apartment buildings locally and in the city of New York. A number of those buildings, particularly in the city, have live in superintendents, and the question arises as to whether that superintendent has to be paid overtime particularly because the superintendent is more or less on call 24/7. Again, the answer is it depends.


It appears that under New York State law under certain circumstances the employer will not have to pay that superintendent overtime. We look at the facts of the situation including whether the superintendent is being provided living accommodations as part of his employment deal. Under federal law it is less clear that such a live in superintendent may be exempt. Again, our Orange County Employment Lawyers look at all the facts and circumstances and try to give a reasoned opinion as to whether the employee must be paid overtime.
